Introduction and Mission Statement

Stephen C. Foster Fine Arts Advisory and Brokerage is a full service brokerage reserved for, and designed to serve, high end transactions. The firm's primary purpose is to provide a third party position designed to bridge the interests of both buyer and seller.

Its objectives include achieving direct relationships, through mediation, between buyers and sellers or between their mandated agents, the purpose of which is to avoid the all too frequent disappointments encountered in the pursuit of sales and purchases. We believe that a company which requires commitment by involved parties of both sides and imposes discipline and legal oversight on transactions is beneficial to all concerned.

Stephen C. Foster Fine Arts Advisory and Brokerage assumes an independent and neutral position of mediation, brokering and consulting only. Ours is a position of non-advocacy of buyer or seller and adopts an independent middle position formalized through a brokering agreement. The relationship created by this agreement is that of independent contractor. The broker is not an employee of either party, and is not subject to the control or direction of ether party.

Methodical steps are taken to guarantee the seriousness of both the selling and the buying sides and to avoid parties of either side wasting their time on deals that are not "real." From the outset, we establish the commitment of the buying side to buy and the commitment of the selling side to sell. Our contract requires the direct participation of the people duly authorized by the seller and buyer to represent their interests - both the agents and/or the attorneys for the agents.

Prosecution of a transaction depends on the authentication of involved parties (including their attorneys), on our firm's legal satisfaction with all aspects of the transaction, and on the written and mutual agreement, by both parties, confirming the acceptability of the players, terms, and conditions of the sale.
